1. About These Terms

These Terms and Conditions govern your use of the Green Wave website, pledge forms, campaign resources and related online services.

Green Wave is an initiative of the Curaçao Clean Up Foundation.

By accessing the website or submitting a pledge, you agree to these Terms and Conditions. When you do not agree, you should not submit information through the website.

2. Purpose of the Website

The website is intended to:

• Promote the Green Wave campaign

• Encourage responsible environmental behaviour

• Allow individuals and organizations to sign the Green Wave Pledge

• Share campaign actions and educational resources

• Display campaign progress and participating partners

• Connect participants with Green Wave communications and communities

The website does not provide legal, environmental, financial or professional advice.

3. The Green Wave Pledge

The Green Wave Pledge is a voluntary statement of intention.

By signing the pledge, you express a good-faith commitment to support a cleaner, greener and stronger Curaçao through the actions selected or described.

Unless expressly agreed otherwise in writing:

• The pledge does not create an employment, agency, partnership or commercial relationship

• Green Wave does not supervise every pledged activity

• Green Wave does not guarantee that every participant will complete every selected action

• The pledge does not replace compliance with environmental, waste-management, labour, health and safety or other applicable laws

4. Business and Organization Submissions

A representative submitting the Business Pledge confirms that:

• The information provided is accurate to the best of their knowledge

• They are authorized to submit the pledge on behalf of the organization

• The organization has permission to provide and use the uploaded logo

• The selected commitments reflect the organization’s genuine intentions

• The submission does not infringe another party’s rights

Green Wave may contact the representative to verify or clarify a submission.

5. Partner Status and Partner Wall

Submitting the Business Pledge does not automatically guarantee publication or official partner recognition.

Green Wave may:

• Review submissions

• Request additional information

• Approve or decline a listing

• Resize or reformat a submitted logo

• Delay publication while verification is completed

• Remove an organization from the Partner Wall

A listing may be refused or removed when:

• Information appears inaccurate or misleading

• The logo or content infringes intellectual-property rights

• The organization acts in a way that conflicts with the campaign’s purpose

• The organization misrepresents its Green Wave involvement

• Continued display could damage the integrity or reputation of Green Wave or CCU

• Removal is required by law

6. Use of Green Wave Name and Branding

The Green Wave name, logo, campaign graphics, website content and related materials may be protected by copyright, trademark or other intellectual-property rights.

Unless written permission or an approved toolkit expressly allows it, users may not:

• Alter the Green Wave logo

• Present themselves as the owner or official operator of Green Wave

• Use Green Wave branding in a misleading way

• Sell Green Wave campaign materials

• Suggest an endorsement that has not been granted

• Copy substantial website content for commercial purposes

Approved partners may use authorized Green Wave Partner materials only in accordance with the instructions provided.

7. User-Submitted Content

When you upload a logo, image, statement or other material, you confirm that:

• You own it or have permission to submit it

• It does not violate another person’s rights

• It is not unlawful, harmful, discriminatory, defamatory or misleading

• It does not contain malicious software

You grant Green Wave and CCU permission to store, review, resize and, where you have consented, display the submitted organization name and logo for campaign-related purposes.

You retain ownership of your organization’s logo.

8. Acceptable Use

You may not use the website to:

• Submit false or fraudulent information

• Impersonate another individual or organization

• Upload harmful files or malicious code

• Attempt unauthorized access to website systems

• Interfere with the website’s operation

• Harvest participant information

• Misuse campaign statistics

• Send spam

• Publish unlawful or offensive content

• Falsely claim Green Wave Partner status

9. Campaign Counts and Impact Information

Participation counters and impact figures may be based on:

• Submitted pledge forms

• Approved organization registrations

• Estimated employee ranges

• Campaign reports

• Manually verified records

These figures may be rounded, delayed, corrected or updated.

Green Wave aims to present accurate information but does not guarantee that a public counter will update instantly or be free from duplicate, incomplete or test submissions.

10. Third-Party Links and Services

The website may link to or embed services operated by third parties, including social-media, messaging, form, analytics and website providers.

Green Wave does not control these services and is not responsible for:

• Their availability

• Their terms or privacy practices

• Content published by third parties

• Losses arising from independent third-party services

Use of those platforms is subject to their own terms.

11. Availability of the Website

We aim to keep the website accessible but cannot guarantee uninterrupted availability.

Green Wave may temporarily suspend, change or discontinue part of the website for:

Participants and organizations remain responsible for conducting clean-ups and environmental activities safely and in accordance with applicable laws, permits and health-and-safety requirements.

To the extent permitted by law, you agree to be responsible for losses or claims resulting from:

• Information or materials you submit unlawfully

• Unauthorized use of another party’s logo or intellectual property

• Misrepresentation of your authority or partner status

• Serious misuse of the website
   

15. Privacy

Personal information submitted through the website is handled in accordance with the Green Wave Privacy Policy.

16. Changes to These Terms

Green Wave may revise these Terms when the campaign, website or legal requirements change.

The updated Terms will be posted on this page with a revised date. Continued use of the website after an update means the revised Terms apply to future use.

17. Governing Law

These Terms are governed by the laws of Curaçao.

Any dispute relating to the website or these Terms will be submitted to the competent courts of Curaçao, unless applicable law requires otherwise.
